By downloading, installing, or using Apex Workouts (the "App"), you agree to these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and Thom Sterenborg ("Developer", "I", "me"), an independent developer based in the Netherlands.

Apex Workouts is intended for users aged 13 and older. By using the App, you confirm that you are at least 13 years of age. Users under the age of 18 should review these Terms with a parent or guardian before using the App.

Additionally, before starting any new exercise programme, users of any age are strongly advised to consult a qualified medical professional, particularly if they have any pre-existing health conditions.

Apex Workouts is a free, offline-first iOS fitness application that allows you to plan, track, and review your workouts. The App operates entirely on your device and requires no account registration or internet connection for core functionality.

The App is provided free of charge with no in-app purchases, subscriptions, or advertising.

IMPORTANT: Apex Workouts and its AI motivator Axel are not substitutes for professional medical or fitness advice. Always consult a qualified healthcare provider or certified fitness professional before beginning any exercise programme.

Not Medical Advice

The content provided within Apex Workouts, including workout plans, exercise descriptions, nutritional suggestions, and any output generated by Axel, is intended for general informational and motivational purposes only. It does not constitute medical advice, diagnosis, or treatment.

If you have or suspect you have a medical condition, are pregnant, are recovering from injury or surgery, or have any other health concern, you must consult a qualified medical professional before using this App or following any fitness guidance it provides.

Axel --- AI Motivator Disclaimer

Axel is an AI-powered motivator built into Apex Workouts. Axel runs entirely on your device using Apple's on-device Foundation Models and is designed to encourage, motivate, and support your fitness journey.

Axel is not a medical professional, certified personal trainer, physiotherapist, dietitian, or any other licensed health or fitness professional. Axel's responses are generated by an AI model and should never be interpreted as professional advice. Specifically:

• Axel cannot diagnose injuries, illnesses, or medical conditions

• Axel cannot assess your physical fitness level or limitations

• Axel cannot provide rehabilitation or post-injury exercise guidance

• Axel's motivational suggestions may not be appropriate for your individual circumstances

If you have any questions or concerns about your health, fitness, or wellbeing, please consult a qualified professional rather than relying on Axel.

Injury & Liability Waiver

Exercise carries an inherent risk of injury. By using Apex Workouts, you acknowledge and accept these risks and agree that the Developer is not liable for any injury, illness, loss, or damage of any kind arising from your use of the App or any exercise activity you undertake as a result of using the App.

This includes, but is not limited to:

• Acute injuries such as sprains, strains, fractures, or dislocations

• Overuse injuries or repetitive strain injuries

• Cardiovascular events during or following exercise

• Injuries caused by incorrect exercise form or technique

• Injuries caused by exercising beyond your physical capacity

• Any other physical or psychological harm related to exercise

You exercise at your own risk at all times. It is your responsibility to exercise safely, use proper form, select appropriate weights and intensity levels, and stop immediately if you experience pain, dizziness, shortness of breath, or any other unusual symptoms.

All content within Apex Workouts --- including but not limited to the app design, source code, graphics, branding, the Axel character and name, workout structures, and text --- is the intellectual property of the Developer and is protected by applicable copyright and intellectual property laws.

You are granted a personal, non-exclusive, non-transferable, revocable licence to use the App on your iOS device for personal, non-commercial purposes. You may not:

• Copy, modify, or distribute any part of the App

• Reverse engineer or attempt to extract the source code

• Use the App's content for commercial purposes

• Remove or alter any copyright, trademark, or proprietary notices

Apex Workouts integrates with Apple HealthKit to read and write fitness and health data. This integration is optional and operates entirely on-device. By granting HealthKit permissions, you allow the App to access the specific data categories you approve within iOS Settings.

HealthKit data is never transmitted outside your device by Apex Workouts. You can revoke HealthKit access at any time via Settings > Health > Apps > Apex Workouts.

Apex Workouts is provided as-is and free of charge. The Developer makes no guarantee of continuous availability, and the App may be updated, modified, or discontinued at any time without prior notice.

Updates distributed via the App Store may change the features, design, or functionality of the App. Continued use of the App after an update constitutes acceptance of any revised Terms.

To the fullest extent permitted by applicable law, Apex Workouts is provided "as is" and "as available" without warranties of any kind, either express or implied. The Developer does not warrant that:

• The App will be error-free or uninterrupted

• The App will meet your specific fitness or health goals

• Information provided within the App is accurate, complete, or current

• The App will be compatible with all iOS devices or future iOS versions

To the fullest extent permitted by law, the Developer shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from your use of or inability to use Apex Workouts. This includes, without limitation, damages for personal injury, loss of data, loss of profits, or any other losses, even if the Developer has been advised of the possibility of such damages.

Nothing in these Terms limits liability that cannot be excluded under applicable Dutch or EU consumer protection law.

These Terms are governed by and construed in accordance with the laws of the Netherlands. Any disputes arising from these Terms or your use of the App shall be subject to the jurisdiction of the competent courts in the Netherlands.

If you are a consumer resident in the European Union, you may also have rights under the consumer protection laws of your country of residence.

The Developer reserves the right to update these Terms at any time. When changes are made, the effective date at the top of this document will be updated. For significant changes, a notice will be displayed within the App. Your continued use of the App after any changes constitutes acceptance of the revised Terms.
